
Making a Claim on a Claimant Basis
This is the method of 'claim' most commonly used within the financial claims industry. This method may be utilised for claims against existing and redeemed mortgages, loans, motor finance and existing credit cards.
The Claimant model offered by Grass Roots can be used to progress claims against mortgages and secured loans across a number of potential areas of claim.
Making a claim on a claimant basis involves Grass Roots first identifying any potential areas of claim. This is done using rights under the Data Protection Act and/or Consumer Credit Act to obtain all the relevant information from your lender. For this reason it does not matter if you no longer have any paperwork relating to the product (if redeemed). If you have, or can obtain, an account number we should be able to obtain the required information.
Should an area of claim be identified, we will notify you and either a specialist department within Grass Roots, a legal partner or a firm of solicitors will take over the claim process.
Once a solid foundation for a claim has been built, the lender will be informed and given the option to enter into a negotiated settlement without the need for court proceedings. Should an acceptable settlement not be forthcoming then, providing a claim has reasonable prospects of success, the process of issuing court proceedings can begin.
The length of a claim made on a claimant basis can vary immensely. For example, a claim for a clear and obvious mis-sale of Payment Protection Insurance may conclude within as little as a couple of months. Conversely, a complicated claim based on areas of claim that require the conclusion of 'test cases' and any appeals may take a few years.
Grass Roots Client Account ensures that the Service Fee paid is protected and available for a refund should no claim be viable. Not all claims management companies give this protection.
